2nd Circ. Affirms Capital One Win In Loan Bias Suit

Law360, Los Angeles (March 13, 2014, 7:59 PM EDT) -- The Second Circuit on Thursday affirmed the dismissal of a suit claiming Capital One Financial Advisors engaged in discriminatory home loan practices, agreeing with the lower court that a $14.8 million settlement in a prior action barred the plaintiff from bringing her complaint.

In a summary order, a three-judge panel upheld U.S. District Judge Laura Taylor Swain's ruling dismissing named plaintiff Ibelka Vargas' suit, rejecting Vargas' arguments that she wasn't adequately represented in a class action brought in 2008 against Capital One subsidiary GreenPoint Mortgage Funding...
