DMCA Protects YouTube, Google Claims

Law360 (May 27, 2008, 12:00 AM EDT) -- Viacom Inc.'s $1 billion copyright infringement claims against YouTube LLC challenge the protections for Internet services that the U.S. Congress laid out in the Digital Millennium Copyright Act, Google Inc. has claimed.

“Congress recognized that such services could not and would not exist if they faced liability for copyright infringement based on materials users uploaded to their services,” according to Google, which filed its answer to Viacom's amended complaint on May 23 in the U.S. District Court for the Southern District of New York.
