TracFone's $40M Settlement Over False Advertising Approved

Law360, Washington (July 6, 2015, 1:59 PM EDT) -- TracFone Wireless Inc. won a California federal judge’s stamp of approval Thursday on a $40 million settlement with a proposed class that had alleged false advertising in the company’s unlimited plan because it "throttled" data usage after a certain amount.

U.S. District Judge Edward M. Chen found the settlement — which adds $5 million in attorneys' fees for the class counsel to the $40 million for the users — was more than fair to the proposed class of up to 8 million users because, although they had a strong case, the class members were vulnerable to strong defenses by TracFone....
