Trinity To Appeal $663M Guardrail FCA Verdict To 5th Circ.

Law360, Washington (August 31, 2015, 5:33 PM EDT) -- Trinity Industries Inc. gave notice Friday that it was going to the Fifth Circuit to challenge a whistleblower's successful $663 million False Claims Act judgment against it in Texas federal court over selling defective guardrails.

The notice of appeal — which offered no additional details — comes less than a month after U.S. District Judge Rodney Gilstrap refused to grant Trinity a new trial, rejecting the company's arguments that the damages award was excessive and that a new trial was warranted given newly discovered evidence that shows the company's ET Plus guardrail system passed government crash tests.
