NY, NJ Dunkin' Donuts Accused Of Charging Illegal Tax

Law360, New York (February 9, 2016, 5:06 PM EST) -- Dunkin' Donuts flouts the law and dupes consumers by illegally charging a tax on pre-packaged coffee and other tax-exempt products, a proposed class of New York and New Jersey consumers said in two complaints filed Monday.

New York law prohibits sales tax on most food, and it specifically lists coffee as a tax-exempt item. In New Jersey, both coffee and bottled water are exempt from sales tax, the class action complaints filed in New York federal court and New Jersey state court said.
