3rd Circ. Puts Gambling Ban Constitutionality Back On Table

Law360, New York (February 17, 2016, 10:34 PM EST) -- A 12-judge Third Circuit panel heard arguments over New Jersey's efforts to legalize sports betting Wednesday, making it the third time the appeals court has looked at the issue, but questioning showed the case could be far from over as the court indicated it was open to reconsidering the constitutionality of a federal ban.

New Jersey's bid to open up sports betting within its borders has already been shot down twice by the Third Circuit as violating the federal Professional and Amateur Sports Protection Act, which prohibits states from authorizing sports betting.
