Mercedes Accused Of VW-Style 'Defeat Device' In Lawsuit

Law360, New York (February 18, 2016, 8:37 PM EST) -- In what counsel at Hagens Berman Sobol Shapiro LLP is calling the first such suit against Mercedes-Benz, the automaker was hit Thursday with a putative class action alleging several diesel models have Volkswagen-style “defeat devices” that let them ace emissions inspections while otherwise producing pollutants at many times allowed levels.

Coming amid a similar scandal that has caused fellow German carmaker Volkswagen’s stock price to plummet, this new suit in New Jersey federal court claims Mercedes-Benz USA LLC has installed in its supposedly clean vehicles a device that shuts off its emissions-scrubbing system when the ambient temperature drops below 50 degrees...
