Bio-Rad Can't Block Ex-GC's Evidence In Retaliation Trial

Law360, Los Angeles (December 22, 2016, 7:46 PM EST) -- A California federal judge has rejected Bio-Rad Laboratories Inc.'s bid to block its former general counsel's evidence as privileged information in the attorney's lawsuit claiming the company fired him for raising concerns about its Foreign Corrupt Practices Act compliance in China, saying whistleblower laws permit the disclosures.

U.S. Magistrate Judge Joseph C. Spero said Tuesday that federal common law permits plaintiff Sanford Wadler to use otherwise privileged information in his retaliation case, and that the Sarbanes-Oxley Act preempts California's rules regarding attorney-client privilege.
