Texas Court Hands Patent Win To Roku Over Improper Venue

By Nicole Narea (July 6, 2017, 7:54 PM EDT) -- A Texas federal judge dismissed a patent infringement suit brought against media-streaming service Roku Inc. by Texas-based nonpracticing entity Blue Spike LLC, finding Wednesday that the venue was improper under the U.S. Supreme Court's recent TC Heartland decision because Roku does not do business in the state.

After Blue Spike failed to respond to Roku's motion to dismiss the case, Judge Robert W. Schroeder accepted Roku's assertions as fact and concluded that Roku was based in Delaware with a principal place of business in Northern California.
