Lost Baggage Suit V. British Airways Gets Green Light

Law360 (April 6, 2009, 12:00 AM EDT) -- A judge has refused to dismiss a putative class action accusing British Airways PLC of recklessly mishandling and frequently losing its passengers’ baggage.

Judge Nicholas Garaufis of the U.S. District for the Eastern District of New York on Monday denied BA’s motion to dismiss the case, rejecting the airline’s argument that that the plaintiffs had failed to adequately allege that the airline had acted recklessly in losing or damaging passenger baggage.
