9th Circ. Revives Cinemark Workers' Wage Suit

Law360, New York (December 7, 2017, 3:25 PM EST) -- A Ninth Circuit panel refused Thursday to toss an appeal by Cinemark workers seeking to revive their putative wage class action, finding the appeals court maintained jurisdiction despite the settlement of some claims and reversing the lower court’s dismissal.

Cinemark and Century Theaters had sought to dismiss allegations that workers received incorrect wage statements, citing the U.S. Supreme Court's 2017 decision in Microsoft Corp. v.
