Starbucks Wins Dismissal Of Calif. Underfilled Iced Drink Suit

Law360, Los Angeles (August 22, 2016, 4:14 PM EDT) -- A California federal judge Friday shot down a proposed class action alleging Starbucks Corp. tricks purchasers of its iced drinks by underfilling the cup with actual liquid, saying the reasonable consumer would expect a cold drink would include both the drink and ice.

Citing young children as even those who understand ice displaces liquid in a cup, U.S. District Judge Percy Anderson said there was no weight to plaintiff Alexander Forouzesh’s claims that the coffee retailer defrauds consumers by filling cold liquid only up to a certain point in its cups before topping them with ice to make them appear full....
