5th Circ. Wary Of Clinic's Bid To Revive NFL Benefits Suit

Law360 (June 10, 2021, 2:33 PM EDT) -- A Fifth Circuit panel appeared unswayed Thursday by a medical clinic's argument to revive its Texas federal lawsuit against the National Football League for allegedly telling Cigna not to pay claims for players who used its services.

The three-judge panel asked few questions during the in-person oral arguments, focusing on whether Advanced Physicians SC's Illinois state law claim of interference with prospective economic advantage against the NFL is blocked by the Employee Retirement Income Security Act, which governs most interactions between retirement and health plans and their beneficiaries. A district court determined the clinic's claim is preempted.
