Cynosure Agrees To Pay $16M To End Unwanted Fax TCPA Suit

Law360, Los Angeles (January 26, 2017, 9:50 PM EST) -- Aesthetic laser procedures company Cynosure Inc. agreed to $16 million to settle allegations it violated the Telephone Consumer Protection Act with faxed advertisements for seminars marketing its hair removal and skin treatments, according to a proposed settlement filed in Massachusetts federal court on Thursday.

An Arkansas business filed a putative class action accusing Cynosure of unlawfully faxing unwanted advertisements about its products in violation of the TCPA last year. The parties stayed the action in order to head into mediation, and on Thursday asked the court to grant preliminary approval to their $16 million deal.
