Most Anti-Bayer Expert Testimony Barred In Mirena IUD Suit

Law360, New York (March 9, 2016, 4:44 PM EST) -- A New York federal judge on Tuesday blocked nearly all testimony by expert witnesses for consumers claiming they were injured by Bayer Healthcare’s Mirena intrauterine contraceptive devices, a decision Bayer said could affect the upcoming trial in the multidistrict litigation.

U.S. District Judge Cathy Seibel barred four of the experts entirely, finding that they weren’t qualified to opine on the case, their opinions weren’t reliable, or both. The other two experts were allowed to testify, but only on certain subjects, as were two of Bayer’s experts, the judge said.
