Kmart Data Breach Class Actions Denied MDL Consolidation

Law360, New York (June 9, 2015, 7:08 PM EDT) -- The U.S. Judicial Panel on Multidistrict Litigation on Monday refused to consolidate five separate class actions accusing Kmart Corp. of using outdated security measures when its networks were breached by hackers last year, finding that there are not enough cases to merit consolidation.

The panel specifically refused to grant consolidation to three of the class actions, one each in Illinois, Pennsylvania and Louisiana federal court, suggesting instead that the cases all be transferred to Illinois to better coordinate discovery and pretrial rulings on their accusations that...
