Oil Producers Cannot Recover From Downstream Purchasers

By Edward Ripley, Thad Wilson and Sarah Primrose (August 1, 2017, 3:13 PM EDT) -- In an opinion that resolved an almost decade-long dispute between various oil producers and downstream purchasers over oil bought and sold by SemGroup LP (collectively, with its affiliates including SemCrude LP, "SemGroup"), the U.S. Court of Appeals for the Third Circuit recently upheld a district court's ruling that downstream purchasers took oil purchased from a bankrupt intermediary free and clear of the oil producers' liens.
