Disbarred Atty Can't Beat Prison Term Over 'Confused' Judge
Law360 (May 16, 2019, 6:46 PM EDT) -- The Third Circuit on Thursday nixed a disbarred attorney’s bid to toss his revised 41-month prison term for his role in bogus investment schemes, rejecting his claims that a New Jersey federal judge was “confused” about its prior rulings and “unprepared” to conduct the resentencing hearing.
Among other arguments, former criminal defense attorney Pasquale “Pat” Stiso made those allegations in challenging U.S. District Judge William J. Martini’s “fairness” during his 2017 resentencing, but a circuit panel said that “attack on the soundness of the proceeding is entirely unsupported by the record.”
