5th Circ. Focused On Disputed Offers In Avanci Antitrust Case

By Matthew Perlman (October 7, 2021, 8:45 PM EDT) -- A Fifth Circuit panel questioned an auto component supplier and a group of technology companies, along with patent-licensing entity Avanci, during oral arguments Thursday about whether the supplier had in fact been offered licenses for standard-essential patents.

U.S. Circuit Judge Carl E. Stewart interjected early-on in the arguments to ask an attorney for Continental Automotive Systems Inc. to "cut to the chase" about where the lower court went wrong in tossing the case accusing Nokia, Sharp and others that provide licenses through Avanci of antitrust violations.
