Bayer Fails To Scrap Aspirin Marketing MDL

Law360, New York (March 31, 2010, 3:56 PM EDT) -- Bayer Healthcare LLC has lost its bid to toss the 11 product liability actions consolidated in multidistrict litigation accusing the pharmaceutical giant of illegally marketing its combination aspirins as a way to fend off heart and bone disease.

Judge Brian M. Cogan of the U.S. District Court for the Eastern District of New York denied Bayer's motion to dismiss the suit Tuesday, rejecting the company's argument that the MDL is “nothing more than an impermissible private attempt to enforce the Food, Drug and Cosmetic Act” and...
