Dish Bests Class Action Over Sports Channel Outage

Law360, New York (September 16, 2011, 7:34 PM EDT) -- A federal judge on Thursday threw out a putative class action brought against Dish Network LLC by a Georgia man who claimed the TV provider broke its customer agreements when it failed to broadcast Fox Sports South last October.

U.S. District Judge Charles A. Pannell Jr. ruled that Matthew McClamrock, who allegedly lost access to Fox Sports South programming for 28 days, didn’t present a triable issue because Dish’s service and customer contracts clearly said it wouldn’t be held liable for service interruptions.
