Mark Holders Denied Class Cert. In Google AdWords Suits

Law360, New York (September 29, 2011, 8:00 PM EDT) -- A Texas federal judge on Thursday refused to certify two classes of advertisers led by FPX LLC and John Beck Amazing Profits LLC in separate infringement suits against Google Inc. for its practice of selling trademarks to competitors as keywords for targeted advertising.

The companies claimed Google's AdWords program, which allows companies to purchase the right to appear as sponsored links based on search terms entered on Google.com, misleads consumers by associating certain sponsors with unrelated marks.
