5th Circ. Snuffs Suit Over Civilian Driver Deaths In Iraq

Law360, New York (January 12, 2012, 10:22 PM EST) -- The Fifth Circuit on Thursday blocked a suit brought by families of civilian drivers killed in Iraq in 2004, finding the tort-based claims were preempted by a federal workers' compensation statute that bars legal action against private military contractors.

A three-judge panel vacated a Texas federal court decision that denied Houston-based KBR Inc.'s motion to dismiss and remanded it with instructions to toss the state tort claims. KBR's former parent company, Halliburton, was also named as a defendant in the suit.
