Pfizer, Others Sued By Health Plans Over Copay Coupons

Law360, New York (March 7, 2012, 5:52 PM EST) -- Pfizer Inc., GlaxoSmithKline PLC and six other major drugmakers were sued in class actions under federal racketeering and antitrust laws Wednesday for allegedly subsidizing illegal copayments for brand-name prescription drugs such as Lipitor and Nexium through the promotion of copay coupons.

A coalition of health plans allege that Abbott Laboratories, Amgen Inc., AstraZeneca PLC, Bristol-Myers Squibb Co., GSK, Merck & Co. Inc., Novartis AG and Pfizer are paying undisclosed kickbacks to privately-insured individuals so that they choose the companies' brand-name drugs instead of less expensive alternatives....
