Lucky Brand, Others Pay $10M To End Text-Spam Class Action

Law360, New York (November 27, 2012, 3:09 PM EST) -- A California judge on Monday gave a preliminary nod to a nearly $10 million class action settlement between Lucky Brand Dungarees Inc., its marketing subcontractors and a nationwide class of consumers who accused them of text-spamming them as part of a 2008 back-to-school promotion.

All persons who received promotional texts advertising discounted Lucky Jeans between Aug. 24 and Sept. 15, 2008 will be entitled to up to $100 under the deal, which resolves claims brought by two California residents who claimed the text campaign was a violation...
