High Court Sides With Comcast In Antitrust Class Action

Law360, New York (March 27, 2013, 2:00 PM EDT) -- The U.S. Supreme Court ruled Wednesday in favor of Comcast Corp. in a lawsuit alleging it monopolized the Philadelphia cable market, saying the Third Circuit should have taken a closer look at the plaintiffs' damages model before certifying the class.

In a 5-4 decision, the court ruled that the Third Circuit had ignored key precedents like the 2011 Wal-Mart v. Dukes decision when it held that questions about expert testimony on which the plaintiffs relied to calculate the alleged damages in the case were merits issues...
