Google Books Class Decertified By 2nd Circ.

Law360, New York (July 1, 2013, 1:41 PM EDT) -- The Second Circuit on Monday overturned the class certification of a group of authors who claim Google Inc.'s project to digitize millions of books violated their copyrights, ruling the lower court should have first considered whether the scanning was a protected fair use.

The appeals court said the June 2012 certification order by the trial court was “premature” in the absence of a ruling on whether “snippets” of millions of books displayed by Google amount to fair use of the copyrighted material.
