Merscorp, BofA Escape Texas Counties' Fraud Claims

Law360, Dallas (November 4, 2013, 7:49 PM EST) -- A Texas federal judge on Monday axed claims Merscorp Holdings Inc. and Bank of America Corp. defrauded Texas counties in their mortgage registration practices, finding no conspiracy that their electronic registration system usurps the county clerk’s role in tracking property ownership interests.

U.S. District Judge Reed O’Connor eliminated fraudulent misrepresentation, unjust enrichment and a derivative civil conspiracy claim from the suit, as well as a request from Dallas County to enjoin the electronic registration practice.
