Judge Boots Bristol-Myers False Claims Suit

Law360, New York (September 26, 2008, 12:00 AM EDT) -- A judge has dismissed a qui tam action, saying the plaintiff did not plead his case sufficiently to proceed in a suit that alleged Bristol-Myers Squibb Co. violated state and federal false claims acts.

In a decision Wednesday, Judge Thad Heartfield of the U.S. District Court for the Eastern District of Texas dropped claims, including including False Claims Acts allegations under the laws of the federal government, California, Illinois, Massachusetts and Texas, that John David Foster had brought against the New York-based drugmaker.
