Wipeout Of Mirena MDL To Be Challenged At 2nd Circ.
By Kat Sieniuc (August 19, 2016, 7:57 PM EDT) -- Women in failed multidistrict litigation alleging that Bayer HealthCare AG's intrauterine device Mirena caused damage after insertion said Friday that they plan to appeal the case to the Second Circuit.
Last month a New York federal judge had wiped out more than 1,200 suits alleging harm from the Bayer's IUD, concluding that the absence of expert testimony made it impossible to prove that Mirena could cause injuries after insertion.
That summary judgment ruling from U.S. District Judge Cathy Seibel ended an MDL alleging Bayer failed to warn women that Mirena could perforate their uterus subsequent and unrelated to insertion.
