New Jersey's TCCWNA: New Year, Same Uncertainty

By Jeffrey Jacobson, Kelley Drye & Warren LLP (January 25, 2017, 1:47 PM EST) -- Online retailers who are defending or at risk of lawsuits under New Jersey's Truth-in-Consumer Contract, Warranty and Notice Act (TCCWNA)[1] had hoped to end 2016 with some clarity as to whether the law is as broad as recent class action complaints have contended. Most of the motions to dismiss those cases remain undecided, however, and there are signs that they may remain undecided until the New Jersey Supreme Court and Third Circuit Court of Appeals issue rulings in TCCWNA-related appeals. Those decisions may not come until much later in 2017....
