Kids Can't Sue US Over Global Warming, 9th Circ. Told

Law360 (February 3, 2019, 1:58 PM EST) -- The federal government on Friday asked the Ninth Circuit to sink a “misguided” lawsuit brought by young people who say federal policies exacerbate climate change, arguing the U.S. government can’t be liable for flooding or drought caused by a global phenomenon.

In its opening brief, the government said several factors disqualify the youthful plaintiffs from proceeding to trial with their claims, including a lack of standing and an inability to show that a court could craft an appropriate remedy.
