COPPA: The Latest Chapter In Consumer Class Actions

The Children's Online Privacy Protection Act (COPPA), 15 U.S.C. §§ 6501 et seq., and the Federal Trade Commission's COPPA Rule, 16 C.F.R. 312, impose requirements on operators of commercial websites or online services that collect, maintain or use a third party to collect or maintain the personal information of children under 13 years of age. COPPA applies to websites or online service providers that direct services to children under 13, have actual knowledge that they collect personal information of children under 13, or collect such personal information from a third party. Third parties that collect personal information from users of websites directed at children also must comply with COPPA....
