10th Circ. Caps Ski Resort Project Insurer's Liability At $5M

Law360 (May 17, 2018, 10:57 PM EDT) -- The Tenth Circuit ruled Thursday that National Union Fire Insurance Co. of Pittsburgh's liability for defects on Intrawest's dozens of ski resort condo construction projects was limited to $5 million total, leaving excess insurer Federal on the hook for the $8 million-plus it shelled out on Intrawest's behalf in two suits.

The panel affirmed a summary judgment decision in favor of AIG-owned National Union, which Chubb-owned Federal Insurance Company had appealed after spending more than $8 million to defend Intrawest and settle claims regarding construction defects...
