CEO Presses Removal Of Judge Who Worked At Debevoise

Law360 (November 24, 2020, 5:33 PM EST) -- The head of a memorabilia auction company has redoubled his effort to convince a New York magistrate judge to bow out from a securities fraud case, objecting to the judge's refusal to exit the litigation because he worked for Debevoise & Plimpton LLP during the 1980s.

Mykalai Kontilai objected Monday under federal civil procedure rules to U.S. Magistrate Judge Gabriel W. Gorenstein's denial Thursday of the Collector's Coffee CEO's argument that the judge's impartiality could be questioned in part because he worked as an associate at Debevoise from 1985 to 1987. Kontilai is suing Debevoise for malpractice in a related case....
