Price Tag, You’re Not It: 4 New Pricing Claims

Law360 (March 23, 2018, 11:40 AM EDT) -- Pricing cases tend to follow a simple formula: The retailer lists a higher price (such as “Original,” “Was,” “Compare At,” “MSRP,” etc.) along with a lower offering price, and the consumer alleges that the higher price was inflated in order to induce the purchase. Most of these cases have targeted apparel retailers, outlet stores, department stores and discount retailers, all with large footprints in California.
