Judge Pares Down Indirect Buyers' Wellbutrin Action

Law360, New York (November 3, 2009, 7:21 PM EST) -- A federal judge has purged state antitrust and consumer protection claims from a putative class action brought by employee benefit plans accusing GlaxoSmithKline PLC of filing baseless patent suits to delay generic versions of antidepressant Wellbutrin SR.

Judge Lawrence Stengel of the U.S. District Court for the Eastern District of Pennsylvania on Monday granted the drugmaker's motion to dismiss antitrust and consumer protection claims brought under a slew of state laws.
