3rd Circ. Urged To Revive Google, Viacom Privacy Claims

Law360, Philadelphia (December 8, 2015, 5:43 PM EST) -- The Third Circuit was urged during oral arguments in Philadelphia on Tuesday to revive a group of class actions claiming that efforts by Viacom and Google to track the online viewing habits of minors are squarely barred by provisions of the federal Video Privacy Protection Act.

Jason Barnes, an attorney with Barnes & Associates representing a group of anonymous minors in the appeal, argued that a New Jersey district judge had erred by concluding that information collected by Viacom.com and shared with Google Inc. did not violate the VPPA because it did not directly identify any of the plaintiffs.
