Payola Probe Inspires Two New Lawsuits

Law360, New York (August 11, 2006, 12:00 AM EDT) -- In further fallout from a 2004 investigation by New York State Attorney General Eliot Spitzer, two independent record labels have filed federal antitrust suits against EMI North America, alleging that the record industry giant is using its “stranglehold” on radio air time to muscle out competitors.

The lawsuits were filed last week on behalf of TSR Records Inc. and Radikal Records Inc. in central California’s district court. The two plaintiffs, identified in court papers as independent record labels, also have antitrust lawsuits pending against Universal Music...
