Copper mining and processing company Asarco LLC has filed a suit accusing the trustee of an environmental cleanup trust it established in bankruptcy of attempting to dodge responsibility for most of two contaminated properties it had been assigned.

The federal government on Tuesday reached a settlement with Asarco LLC in Texas bankruptcy court, agreeing to pay the mining company $15 million to resolve allegations that the U.S. Environmental Protection Agency and the Department of Justice destroyed documents related to the $219.5 million cleanup of a Nebraska Superfund site.

A Texas judge last week preserved a challenge to a $12 million insurance settlement related to asbestos exposure claims brought by contract employees of bankrupt Asarco LLC, refusing to certify an interlocutory appeal by Mt. McKinley Insurance Co. that sought to nix the challenge.
