Law360 (January 14, 2019, 4:02 PM EST) -- Atlanta Falcons stadium project subcontractor Corning Optical Communications on Friday urged a Georgia federal court to dismiss negligence and tort claims against it in IBM's suit accusing it of botching the design and installation of a state-of-the-art cell network.
In a brief accompanying Corning's Friday motion, the wireless technology company argued that the claims either are barred by the economic loss rule or a so-called merger clause in the contracts, or cannot be assigned to the hardware giant by the NFL team or the prime contractor on the project, HHRM.
