Trump Admin. Defends Border Wall Waivers At High Court
Law360 (May 21, 2020, 7:23 PM EDT) -- The federal government on Thursday asked the U.S. Supreme Court to uphold two decisions tossing environmental groups' efforts to halt construction of the Trump administration's southern border wall in California, Arizona, New Mexico and Texas.
While the Center for Biological Diversity and other environmental groups have argued to the high court that the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 violates the Constitution's separation of powers principles by allowing the executive branch too much power to bypass environmental laws, the government said it's well within its rights.
